TERRE HAUTE, Ind. (WTWO/WAWV) — A teen charged as an adult in relation to the case surrounding the murder of Chloe Carroll was sentenced in Terre Haute Thursday.
According to court documents, Cody Scherb pleaded guilty to two felony charges. The first, dangerous possession of a firearm, a level 5 felony, and the second, theft of a firearm, a level 6 felony.
The plea agreement entered called for a six-year prison sentence suspended, with Scherb being placed on formal probation for the same time period.
“The first defendant from the Chloe Carroll homicide investigation was sentenced today to the maximum six-year sentence for his plea of guilty to a Level 5 felony,” Prosecutor Terry Modesitt said. “The other defendant’s case remains with the Indiana Court of Appeals at this time.”
Modesitt said Scherb was involved in stealing a gun from a vehicle the night prior to the shooting death of Chloe Carroll, he then gave that gun to another person who used it in the shooting.
“The evidence from this investigation demonstrated that Cody Scherb had no knowledge that the gun would be used in a shooting, was not involved in the shooting, and was not present when the shooting took place.” Modesitt said. “Nonetheless, a maximum sentence of six years hanging over Mr. Scherb’s head gives him the chance to choose whether he changes his course of life and successfully completes this sentence or whether he continues down the same road, violates his probation, and faces going to prison.”
