TERRE HAUTE, Ind. (WTWO/WAWV) — A recent federal court ruling blocks the City of Terre Haute from enforcing sections of an ordinance that could prevent a prospective adult business.
The Terre Haute Board of Zoning Appeals last year denied property owner Mike Bickers’ request to turn the old Pizza Inn site along Fruitridge Ave. into an “adult-oriented business.”
Bickers filed a federal lawsuit against the board stating that the proposed business met all the requirements for an adult business.
US District Judge James Sweeney last week granted Bickers’ motion for a preliminary injunction which preliminarily restrains the city from enforcing sections to the ordinance.
City attorney Eddie Felling said because the case is still pending, the city is not required to take action at this time. He added that the ordinance will be reviewed to determine if any changes should be made.
Felling said because the ordinance deals with zoning, a review will be a joint effort between Vigo County area planning and the Terre Haute City Council.
