GREENE COUNTY, Ind. (WTWO/WAWV)— UPDATE: The order for the mental health evaluation has been granted.
UPDATE: The state of Indiana has requested life without parole for Penick.
Joshua Alan Penick who was arrested and charged with allegedly murdering a woman and their 14-year-old son has his initial hearing on Tuesday.
Penick is listed as having the initial hearing in the murder case on Tuesday at 11:00 a.m. A search warrant was approved today and the Greene County Circuit Court affirmed that a motion for a mental health evaluation to test the competency and sanity of Penick is being considered.
Penick is being represented by Attorney Jennifer Culotta of New Albany Indiana. She will also be his defense attorney for his sexual misconduct trial in Harrison County. The trial date for Harrison County is currently set for January 21.
