VIGO COUNTY, Ind. (WTWO/WAWV) — A man will spend 15 years in prison as part of a 30 year sentence after accepting a plea agreement in Vigo County Superior Court.
Brian A. Donna Jr. pleaded guilty to a level 2 felony charge of robbery resulting in serious bodily injury and a level 4 felony charge of possession of a firearm by a serious violent felon.
As a part of the agreement, the prosecution dropped the remaining charges of rape, burglary, aggravated battery, and criminal confinement.
The charges stem from the events of June 5, 2020, when Donna along with another man broke into a home on 6th Avenue, attacked two people and shooting one resident.
A Vigo County Judge handed down a sentence agreed upon by the prosecution and the defense, of 30 years. 15-years to be served in prison, followed by two and a half years of work release, then two and a half years of home detention, before serving the final 10 years on probation.
When reached for comment on the sentence, prosecutor Terry Modesitt said the victims in the case agreed to the sentence as well.
“I want to commend the work of Detective Kenny Murphy and the Terre Haute Police
Department in solving the case. And the work of Deputy Prosecutor Kevin O’Reilly in prosecuting this case.” Prosecutor Modesitt said. “In arriving at this agreed sentence, our office worked closely with the victims, who expressed their agreement with this result.”
