INDIANAPOLIS (WTWO/WAWV) — Full House Resorts, Inc., one of the applicants that was denied the Vigo County casino license in November of 2021, has filed a notice of dismissal in its lawsuit against the Indiana Gaming Commission, further clearing the way for construction on a casino in Vigo County.
The lawsuit, which claimed the commission violated Indiana’s open door law regarding meetings, was filed on Dec. 17, 2021. Full House and Churchill Downs, Inc. were the two finalists from four applicants considered at the Nov. 17, 2021 meeting in Indianapolis and Churchill Downs was selected by the commission.
The lawsuit, which was filed and dismissed in Marion Superior Court 2, said that the executive session violated the state’s open door law. The lawsuit initially sought in part to void the decision to deny Full House’s application and the decision to grant the license to Churchill.
In a letter sent to the IGC from Full House legal representatives Tuesday, Jan. 4, Full House said that it never “intended for such action to delay economic development or be construed as malicious” and that even if the process were to be repeated, “the outcome is unlikely to be different.”
